O questionamento que norteia este estudo pode ser assim delineado: Como dialogam Escola dos Annales e a Análise de Conteúdo em pesquisas de caráter histórico? A partir dessa questão, a estrutura narrativa traz aproximações epistemológicas entre ambas as escolhas metodológicas e tece problematizações relativas às desconfianças e resistências no entorno das mesmas. Foram consultados estudiosos que tratam da Interdisciplinaridade, Pesquisa em Educação, Análise de Conteúdo, Método e Teorias Históricas. A discussão compreendeu: O lugar da pesquisa histórica/historiográfica; Escola dos Annales e (...) Análise de Conteúdo nas pesquisas qualitativas e a busca do implícito nas fontes. Por fim, o estudo sublinhou possibilidades de diálogo entre Escola dos Annales e Análise de Conteúdo. (shrink)

The present paper explores the role of motivation to observe a certain outcome in people’s predictions, causal attributions, and beliefs about a streak of binary outcomes. In two studies we found that positive streaks lead participants to predict the streak’s continuation, but negative streaks lead to predictions of its end. More importantly, these wishful predictions are supported by strategic attributions and beliefs about how and why a streak might unfold. Results suggest that the effect of motivation on predictions is mediated (...) by a serial path via causal attributions to the teams at play and belief in the hot hand. (shrink)

O objetivo do presente artigo é defender as seguintes teses. Em primeiro lugar, as teorias da justiça de Habermas e Rawls devem ser vistas como duas versões do construtivismo kantiano, entendido como abordagem metaética que pretende reunir anti-realismo e cognitivismo forte. Em segundo lugar, o contraste com o “construtivismo reconstrutivista” de Habermas ajuda a esclarecer de que modo a teoria de Rawls atende à pretensão de universalidade própria do cognitivismo forte. Ao realçar o fato de que o construtivismo de Rawls (...) está baseado no trabalho reflexivo da consciência individual, o contraste com Habermas permite compreender em que sentido os conceitos de equilíbrio reflexivo e consenso sobreposto designam um ideal com pretensão de validade universal, o que desmente o particularismo implicado nas interpretações coerentistas e relativistas destes conceitos. Soren Kierkegaard's Works of Love, a series of deliberations on the commandment to love one's neighbor, has often been condemned by critics. Here, Ferreira seeks to rehabilitate Works of Love as one of Kierkegaard's most important works. He shows that Kierkegaard's deliberations on love are highly relevant to some important themes in contemporary ethics, including impartiality, duty, equality, mutuality, reciprocity, self-love, sympathy, and sacrifice. Ferreira also argues that Works of Love bears on issues peculiar to a religious ethic, (...) such as the role of God as "middle term," and the possibility of preserving the aesthetic dimensions of love in a religious ethic of relation. The increasing use of digital technologies in judicial and arbitration proceedings increases the usage of digital evidence by the parties, which brings the necessity of creating patterns for adjudicators to admit and assess this new type of evidence. This paper generally addresses digital evidence focusing on the second moment in international arbitration proceedings. It also narrows the topic to hacked and leaked evidence and its admissibility in international arbitration. The literature review showed a significant amount of research devoted to the (...) evidence in arbitration. Some considered electronic evidence within one jurisdiction; others focused on certain forms of digital evidence such as electronic signatures. Papers on digital evidence in international arbitration approach arbitration rules for digital evidence but skip admissibility issues. No systemic and complex works research digital evidence in arbitration, explicitly focusing on the admissibility of hacked and leaked digital evidence from a comparative perspective. Also, no research deals with enforcing international arbitration awards relying on illegally obtained digital evidence. In these cases, there could be a possible violation of domestic public policy under the New York Convention terms (art. V, 2, b). That is why the paper aims to offer the concept of digital evidence in international arbitration, including hacked and leaked evidence, criteria of its admissibility and relevance, and design the arbitration guidelines for assessing hacked and leaked evidence. Comparative legal analysis of the international arbitration rules and national procedure law allowed us to compare the regulatory approaches to the definition of digital evidence and its admissibility worldwide. The method of legal modeling allowed designing model guidelines for arbitral tribunals to evaluate the admissibility and relevance of digital evidence, including hacked and leaked evidence. Moreover, the case study method allowed us to analyze jurisprudence and define criteria for admission of hacked and leaked evidence. We conclude that the admissibility of hacked and leaked evidence depends solely on the arbitrator’s broad discretion to assess the evidence. Nevertheless, thorough evidence analysis and a well-reasoned award are always mandatory. (shrink)

No Tratado político, Espinosa, ao primeiro movimento do texto, faz dura crítica àqueles que criaram utopias ao tratarem da política. Tais filósofos, afirma, por tomarem os homens não pelo que são, mas pelo que gostariam que fossem, conceberam uma forma de política que nunca pôde ser posta em aplicação. Tese muito próxima à de Maquiavel, presente em O Príncipe, segundo a qual, para escrever coisa útil neste campo, deve-se ir direto alla verità effettuale della cosa che alla immaginazione di essa. (...) Não casualmente, portanto, no Capítulo V do Tratado político, último parágrafo, Espinosa usa os termos ‘agudíssimo’ e ‘prudentíssimo’ ao se referir ao florentino. Há mais Maquiavel em Espinosa para além das citações elogiosas? O artigo procurará tratar desta questão ao mostrar alguns traços comuns às respectivas filosofias políticas. Ao que indicam as fontes primárias e alguns comentadores, Espinosa teria se apropriado, e reconceitualizado, à sua maneira, teses-chave do florentino para escrever suas obras, em particular o Tratado político. No primeiro movimento o artigo analisa, em panorama, a ontologia espinosana. Após, mostra como, do interior dos conceitos presentes na ontologia, derivam os de homem, desejo, alegria e tristeza, esperança e medo, segurança e desespero, ação e paixão. Da relação entre ontologia, homens e desejo – bem como dos demais afetos –, são extraídas, em breves considerações, algumas teses políticas de Espinosa. Levanta-se, neste movimento argumentativo, a hipótese de que as teses políticas espinosanas derivam de sua ontologia e de sua (...) concepção de homem como desejo e variação de potência. O conceito de desejo é analisado à luz da variação de potência e do tema do direito natural, o qual, em Espinosa, se identifica a potência. Quando das breves derivações à política, algumas teses hobbesianas – relacionadas aos temas da multidão, povo, representação, direito natural, estado civil, etc. – são trazidas à argumentação para que se mostre, por contraste, o peso das inovações espinosanas. Este artigo investe na ideia de que a infância é um dispositivo histórico do poder. Tem-se como referência analítica Michel Foucault, que concebe a noção de dispositivo em suas discussões a respeito da sexualidade. A hipótese geradora é a de que, a partir do momento em que a criança se torna um dos grupos estratégicos do dispositivo da sexualidade, produz-se sobre ela um conjunto heterogêneo de regimes de verdades e práticas que configura uma maneira de ser e ter uma infância, (...) influindo significativamente nas perspectivas pedagógicas modernas. Dialogando com Deleuze, Agamben e Veyne, considera-se que todo dispositivo possui: linhas de visibilidade e de enunciação que são, respectivamente, máquinas de “fazer ver” e de “fazer falar” ; linhas de força, que sustentam os campos de visibilidade e os regimes de enunciabilidade; e linhas de subjetivação que são, segundo Deleuze a dimensão do “si próprio” e que configuram o sujeito infantil. Apresenta-se três grupos de práticas articuladas às estas características do dispositivo: as práticas pedagógicas, as práticas divisórias e identitárias de gênero e de sexualidade e as práticas médicas. Observa-se que, para Foucault, o dispositivo da sexualidade disciplina os corpos, regula e normatiza a população, regulamenta o prazer e os saberes sobre o sexo, e, além disso, ocupa-se, por meio desse regime sobre o sexo, da preservação da espécie humana. A infância como dispositivo, na perspectiva ora apresentada neste artigo, também regulamenta a criança, constituindo-a em “sujeito infantil”, estabelecendo uma pedagogia e uma ciência que compuseram o pensamento pedagógico moderno sobre e para infância, ocupando-se também da preservação e da manutenção dessa espécie outra, a criança. With the six volumes of the Writings edited by the Peirce Edition Project at Indiana University since 1982, the monumental work of Charles S. Peirce has finally received the care, respect, and love that it deserves. The sixth volume, object of attention of this review, represents a thorough selection and edition of Peirce's writings from 1886 to 1890.

Our goal is to investigate the notion of self-agency in William James and Donald Winnicott. With James, we examine the descriptive element of what constitutes a self. With Winnicott, we explore his explanatory theory on self-emergence. Winnicott's perspective is presented here as the prehistory of the Jamesian self. James's conception of self is similar to the Winnicottian notion of an "integrated self", an embodied position that emerges from the organism's actions in the experiential field. The combination of the two approaches (...) leads to the idea that the self is a flux of identities emerging in interaction with others in the "transitional space" (an intermediate area of experience). They evolved to become Homo Negotiatus; a species that is prone to bargain and to dispute the value of things until some agreement is reached.

Partindo da noção de discurso de Michel Foucault buscamos pontuar os efeitos das falas comumente admitidas sobre o(a) professor(a) nos meios sociais e as formas como essas falas corroboram a instituição da figura do(a) bom(boa) professor(a). Para tanto recorremos aos textos publicados na seção "Obrigado, professor" da revista Nova Escola, sobre os quais empreendemos nossa análise.

Neste trabalho, argumentamos ser a proposta historiográfica de Ubiratan D’Ambrosio (1932-2021), presente em seu Programa Etnomatemática, capaz de nos apoiar nos processos de valorização da historicidade e da diversidade cultural brasileiras. Partindo de uma pesquisa teórica, de abordagem qualitativa e bibliográfica, utilizamos alguns aspectos da perspectiva de D’Ambrosio para fazer o estudo de um episódio histórico do século XVII, baseado na tradução de um livro publicado em 1614 por um missionário francês, que participou do projeto de colonização do Brasil no (...) que ficou conhecido como França Equinocial. Nesse sentido, ao final, apresentamos uma discussão de três trechos dessa tradução que evidenciam conhecimentos astronômicos de um grupo Tupinambá que vivia no Maranhão nessa época. Com isso, buscamos oferecer subsídios para que docentes de Ciências e Física implementem propostas na Educação Básica na perspectiva das Histórias das Ciências especializadas, buscando evitar estereótipos e abordagens ingênuas, de modo a ir ao encontro, por exemplo, da Lei 11.645/2008, a qual exige a inclusão de estudos sobre história e cultura afro-brasileira e indígena em todo o currículo escolar do Brasil. Este é um estudo sobre a mediação da cultura no processo de compreensão e interpretação das normas jurídicas na determinação de seu significado e alcance de sua aplicação concreta, com base no estudo da obra Verdade e Método, de Hans-Georg Gadamer, analisa-se o papel da cultura no procedimento hermenêutico jurídico, tanto do ponto de vista do intérprete, quanto do destinatário da norma jurídica, onde o jurista entra no jogo da interpretação da norma, com o conjunto de preconceitos proporcionado pela tradição, (...) tendo um horizonte que deve fundir-se com o horizonte do caso concreto, para produzir simultaneamente uma compreensão e interpretação da norma, que permita resolver o caso concreto, por uma solução interpretativa criativa que se manifesta através da linguagem, que no que lhe concerne é um produto cultural que permite a compreensão e expressão do pensamento humano em diálogo até com outras culturas, para que a cultura seja o palco, o horizonte onde se dá o processo histórico de formação e aplicação do ordenamento jurídico. Como se a pergunta me fosse dirigida, tenho a impressão de responder que, nesta dissertação, pretendo tão só um pouco de luz sobre o mistério da morte. Tal como a percepção é um mistério, e cada um de nós vive no mundo no interior da fé perceptiva, assim o mistério da vida, (...) que nos permite a existência, envolve a si a esperança de que a morte seja aparência da dimensão do visível. Is the dream of EU endangered? This book reviews classic and modern values and virtues, and uses them in order to rethink Europe's present politics and its future. The idea of the Republic was born with the political ethics of ancient Greece. The current international crisis obliges Europe to face the mirror of truth: What has become of the European Idea and how fares the European Constitution? It has been a long road from the Greek Politeia to the present lack (...) of values and financial monomania in Europe, who seems to have lost any harmony between the spirit, the soul and the body of her Constitution: the will and values of the people (material constitution), the text of the Lisbon Treaty (formal constitution) and its current political interpretation and action (real constitution), making Europe a two-tier or three-tier club, far from the dream of the founding fathers. Without republican values and virtues, and failing to uphold the European social model, the European Union would devolve into moral, social and democratic bankruptcy. (shrink)

The present paper draws a contrast between the notions of τὸ παρ’ ἡμᾶς and τὸ ἐφ’ ἡμῖν to the effect that, according to Chrysippus, each has a different role to play and different requirements to meet, the former being especially tailored to suit the exigencies of praise and blame taken as exhortations, the latter those of desert and justice in praising and blaming as well as honoring and punishing.

Em Parmênides 132b-c é afirmado que se as Ideias fossem pensamentos, então as coisas que participam nelas também seriam pensamentos. A afirmação soa estranha dentro da dinâmica,apresentada no corpus platonicum, da “participação” dos entes sensíveis nas Ideias; todavia, não parece simples determinar o motivo desta estranheza. A chave do problema pode ser uma identificação dos tipos de qualidades das Ideias ou Formas nteligíveis que estão implicados na “participação”. Vários especialistas trataram da matéria na segunda metade do século XX (OWEN, 1968; (...) KEYT, 1969 e 1971; VLASTOS, 1972), tendo sempre como ponto de partida a distinção de qualidades das Ideias traçada no texto dos Tópicos de Aristóteles (137b3-13). Nesse sentido, o presente artigo: i) apresenta os conceitos utilizados no tratamento desta matéria pelos exegetas: “atributos ideais”, “atributos próprios”, “Distinção-P”, “Predicação Paulina”, “Predicação Ordinária” e “Autopredicação”; ii) explica a incompatibilidade da distinção aristotélica de qualidades das Ideias (“Distinção-P”) com a ontologia apresentada nos próprios diálogos platônicos (VLASTOS, 1972 e 1973; CHERNISS, 1944); iii) sugere uma nova “Distinção-P”, mostrando sua compatibilidade com essa ontologia; iv) aplica-a ao caso daquela afirmação sobre as Ideias de Parmênides 132b-c, demonstrando a utilidade dessa distinção pela elucidação que ela promove da dinâmica da “participação” nessa passagem. Através de análises de autoras e avaliação de índices socioeconômicos verifica-se o impacto gerado pela invisibilização das exclusões enfrentadas por mulheres na abordagem Feminista Universal.

The formation of the education professional has been a top subject of studies during the history of education in Brazil and must be a human formation directly related to his or her emancipation as a social, individual person. This is his or her truth citizenship and sine qua non to the formation of a new man for the construction of a human culture. In this sense, the concept of man is the fundamental axis of formation of the education professional. Theoretical (...) matrices that have given rise to individualism and its powerful concepts are analyzed, as well as the new dominant ideas that, in an explicit or implicit way, construct in our society by different forms of social consciousness. There is a firm conviction that the understanding of man as alive, active, and conscious in material existence, according to concrete life, looks as the formation of consensus, organic emancipating scientific fundamental of radial change in social relations on a global society and with the possibility of human culture. I suggest here ecologies of the nascent state, posing the following general questions: what is this state and what is it to live, to fabricate modes of life, in its immanence? I believe populating this state is, by right, ‘ecological’, even if what I offer here is only a sketch or glimpse, playful as it is, of the possibility of such modes of life, of dwelling. As I develop it here, the nascent is in flight of being. It is populated (...) by lesser, minoritarian existences. If it is ‘ecological’, it is because these existences, or modes of becoming, are themselves, in their own right, ‘ecologies’, that is, modes of dwelling, of life, on the ‘other side of existence’, as Antonin Artaud put it once, in exile from Being. The power to return eternally to the nascent state is the power to live, to dwell, in the absolute forgetfulness of Being, in the interstice where philosophy supposedly ends, but where it nevertheless begins again, in oblivion itself, where being is never already the verticality of Being, its difference with beings, but always nascent, in the beginning, eternally so. Based on the readings of the philosophers Gilles Deleuze, Félix Guattari and Michel Onfray, the present article aims to carry out a critical assessment based on what is meant by “control society” and then, inspired by the Nietzschean philosophy of “Super human” [Übermensch], verify the feasibility of flourishing a human type whose creative and courageous posture surpasses the most adverse hypotheses of postmodernity. That said, the research adopts the following method: first, succinctly, to present the development of the different record (...) productions, as presented in The Anti-Oedipus; second, after the Deleuzian work opens up the scope for thinking about the “schizo”, that is, the individual below the social impositions, we complement with the hypothesis of the onfraryan typology of the “condottiere”, making it a model of resistance and insubmission, inspiring, therefore, the possible appearance of a fourth record production analyzed by Deleuze and Guattari. Este artigo tem por objetivo investigar a filiação filosófica dos denominados direitos da natureza. A questão central deste texto é saber se é procedente afirmar que a concepção da natureza enquanto titular de direitos significa rompimento com a ética Antropocêntrica e, entre as correntes da ética Ambiental, qual delas está alinhada com tal perspectiva. Apesar de ser comum a tese de que os direitos da natureza denotam uma posição biocêntrica, este artigo conclui que a posição filosófica que realmente identifica esta (...) formulação é a da ética Ecocêntrica, o que não significa, a rigor, afastamento ou superação do antropocentrismo. investigam-se autores referenciais para a problemática, bem como a legislação constitucional do Equador e da Bolívia. indaga-se também a fundamentação que justificaria reconhecer direitos à natureza, mas não reconhecer direitos aos animais. A metodologia adotada implica análise da bibliografia basilar acerca do tema, que é basicamente de origem estrangeira: europeia, estadunidense e sul-americana. A importância do tema está no exame jusfilosófico da virada paradigmática proposta pela ética Ambiental, notadamente pela ética Animal. Atribuir direitos à natureza significa rever essencialmente os critérios tradicionalmente empregados pelo Direito para o reconhecimento de direitos subjetivos. (shrink)

Palace of the End is a dense triptych of monologues exploring alternative narratives - albeit based in real facts - behind the events and the headlines surrounding the war in Iraq. Borrowing its title from the former royal palace where Saddam Hussein’s torture chamber was located, Thompson’s docudrama is structured as a chain of monologues telling three real-life stories set in the context of the war in Iraq. The play conveys three unconventional interpretations of the realities of war: that of (...) a young American soldier convicted for her misconduct at Abu Ghraib, the prison that stands as one of the most controversial symbols of the American-led Iraq invasion; a British scientist and weapons inspector who denounces what he understands as the false arguments given by his country’s leaders for engaging in a distant war; and an Iraqi mother whose life was shattered firstly by Saddam Hussein’s authoritarian regime, and later by the American first Gulf War. Each story is an enthralling and gut-wrenching reflection of one of the contemporary world’s most studied and controversial conflicts. The play gives voice to three different kinds of war victims, insofar as their political subjectivities and their moral conundrums are concerned. (shrink)

This book examines the significantly similar, yet finally different, thinking of two nineteenth-century existentialist thinkers, Soren Kierkegaard and Friedrich Nietzsche. Its focus is on the different ways each envisioned a joyful acceptance of life - a concern they shared. Each strove to give a place to this acceptance in his picture of life, but their conceptions of it are far apart.
